Section
1 provides that every industry of
facility shall submit the following to the Authority on a routine basis:
- List of raw materials or chemicals used or to be used in the manufacture of its products;
- Conditions of storage of the chemical in subse0ction 1 above section 2
- No person corporate or incorporated bodies or Authority including Government Agencies shall engage in any activity that involves the used chemicals listed in the schedule to these regulations without obtaining a license from the Authority.
- Every industry or factory shall have a detailed emergency respond plan (ERP) in case of accidental discharge or operation out of the normal course of events. Such plan should be made available to the Authority.
- Every industry or facility shall have pollution response equipment’s (PRE) which shall be readily available in the event of emergency situations.
- Every facility shall install pollution control equipment which shall be based on the best practicable technology.
- No industry or facility shall dispose its hazardous waste on water or land without prior treatment to ensure that the concentration or value of the parameters conform with standards as set out in schedule to these Regulations.
- Disposal of treated hazardous wasted shall be in a secure land till or dump site approved by the Authority.
- Every industry or facility with any source or potential source of emission shall measure and report sources and emission date to the Authority.
- Every industry or facility that causes the generation of any odour that unreasonably interferences with any other person’s lawful use best practices and procedures to minimize such odour to bearable minimum levels as contained in schedule to these regulations.
- Any person who willfully hinders, prevents or obstructs any authorized officer or other person in the execution at the regulations shall upon conviction be liable to a fine of twenty thousand naira (20,000) only or to an imprisonment of not more than six months or both.
- Any persons, Authority,
corporate body or unincorporated including Government Agencies or their representatives who fail to a final to comply with any of the provisions of these
regulations shall be guilty of and on conviction in case of an individual to a fine of not more than
one hundred thousand naira (
N100,000) or not more than five years imprisonment and in the case of a firm, corporation or Authority to a fine of not less than one hundred thousand naira (N100,000) and note more than million naira (N1,000,0000). - These regulations may be cited as Kaunda state control and management of hazardous substance regulations no 6 2009.
1. From
my own understanding, this to ensure that all materials used by the industry
including the chemicals are not hazardous
to the health or even if it is hazardous to the health the way to
control it from escaping or causing eminent danger to the environment. The
conditions of the storage should be properly adhere to.
2. The
law does not exclude anybody both corporate or incorporate bodies evening
government Authorities are involve provided that their activities falls within
this law or regulations.
3. Section
3, 4 and 5 expressly provides for heath gadget and fire guard or emergency
response plan in case of accidental discharge. Some industries ignore the
installation of this equipment. Their reason could of financial challenges or
inability to understanding its efficacy. This law have come in place to;
i.
To educate industry on
the danger of using chemical that are not properly store
ii.
Regulate the mismanagement of environment by
industries.
iii.
To ensure that the
environment is fit and conducive for both plant, animal and inanimate objects.
4. Section
6, 7 and 8 deals with environmental degradation in its totality since many
companies are finding of releasing hazardous waste like the Brewies Co .Ltd in
Kaduna situated at United Bus Stop. The deadly smell or odour release by that
company on weekly bases is hazardous to the health. Disposal of waste should be done by the
approval of the of Kaduna State Environmental Protection Authority.
5. Section 10, 11 and 12 provides for its
punishment.

whether by industry, by individual, corporate bodies, government agencies etc
to understanding the need of maintain
good environment.
